State Attorneys General Can Enforce the Emoluments Clause with Quo Warranto vs. Trump’s Hotels

Thanks so much to the authors of this #Emoluments Reblog:

SHUGERBLOG

The Foreign Emoluments clause of the U.S. Constitution states, “no person holding any office of profit or trust under them, shall, without the consent of the Congress, accept of any present, emolument, office, or title, of any kind whatever, from any king, prince, or foreign state.” Article I, Section 9, Cl. 8.  The Compensation (or Domestic Emoluments) clause prohibits the president from receiving, on top of his salary, “any other Emolument from the United States, or any of them.” Article II, Section 1, Cl. 7. An emolument is a kind of payment or benefit. Others have argued persuasively that President Trump has been violating this clause, because foreign states and officials are paying “emoluments” to Trump through the hotels as business conduits. New documents this week show that even though Trump has put his businesses in a trust, he is the exclusive beneficiary of the trust, and he can revoke the…

Each time a man stands up for an ideal, or acts to improve the lot of others, or strikes out against injustice, he sends forth a tiny ripple of hope, and crossing each other from a million different centers of energy and daring, those ripples build a current that can sweep down the mightiest walls of oppression and resistance.

What do Bill Moyers, Jon Oliver & The Pope have in common? Prison Issues.

September 27, 2015 Leave a comment

Prison

Unbelievably, the “home of the free” incarcerates more of its citizenry than any other nation. Moreover, it invests more in prisons than its educational system. In prisons today, we incarcerate the guilty, but also the poor, the sick, the old, the young, and the innocent. While the rich pay bail and go free, the poor are incarcerated until trial–if they don’t take a plea bargain. All the while, families are left without fathers, mothers, brothers and sisters. In this blog post, Bill Moyers and Jon Oliver provide a wealth of information about our culture of imprisonment, and Pope Francis offers his sage advice.

As noted by a CNN Money graph entitled, Education vs Prison Costs, data from 40 states depict how much government money is spent per year to educate an elementary/secondary school student compared to the cost of keeping an inmate imprisoned.” In addition, Online Degrees provides a list of the 10 States That Spend More on Prisons Than Education.

Not to be outdone (but he still needs a few episodes to catch up to Bill), Jon Oliver discusses our penchant for prison, mandatory minimums, and bail.john-oliver-last-week-tonight (2)

By now, you’re asking yourself, what can I do? I know because you wouldn’t have read this far down the post, otherwise. So, yes, you can help. You can help by voicing your concerns to elected officials, advising them to invest in schools not prisons, and you can advocate for those who received sentences that do not or no longer fit the crime. We need pardons and commutations to reduce sentences that were mandatory, especially for judgments that no longer are applicable. You can also help “Witness to Innocence” produce a short documentary that shares the incredible journey of our many Witnesses to Innocence.”

Lastly, we can take the words of Pope Francis to heart and action:

“This time in your life can only have one purpose: to give you a hand in getting back on the right road, to give you a hand to help you rejoin society,” the pope said in the gymnasium of the Curran-Fromhold Correctional Facility. “All of us are part of that effort, all of us are invited to encourage, help and enable your rehabilitation.”

Pope Francis also rebuked society for not doing enough to rehabilitate prisoners. “It is painful when we see prison systems which are not concerned to care for wounds, to soothe pain, to offer new possibilities,” the pope said, speaking in Spanish through an interpreter. “It is painful when we see people who think that only others need to be cleansed, purified, and do not recognize that their weariness, pain and wounds are also the weariness, pain and wounds of society.”

Women: Our Vote, Our History and Our Future

October 25, 2012 3 comments

We owe a debt to the women before us who fought for our rights; not only to fight to keep the rights they worked so hard to obtain, but to ensure future generations will also benefit by living in a country where we have equal rights, equal opportunities, and an equal voice.  In order to do this we all need to know what is at stake which includes our personal civil liberties to make our own decisions about our own bodies without government interference.

In the past few years, we have seen an influx of legislation to eviscerate our healthcare, and the following encompasses the very least you should know regarding their proposed means to do so: The Blunt Amendment, The Personhood Amendment, as well as Mandatory Transvaginal Ultrasounds, and remember, ladies, if these more than distracting proposals were not made we could have focused on alternate objectives such as expanding upon the Lilly Ledbetter Fair Pay Act, the Equal Pay Act, the Paycheck Fairness Act and the reason why our women did so well in the Olympics: Title IX.

Instead of this focus, we were bombarded by men’s views on how they “struggled” to make their decision regarding whether a woman has a right to choose.  Furthermore, some are so bold as to decide when certain choices are deemed justified.  Some allow for an exception to their “Anti-Choice Agenda” if the life of the mother is at stake while others would not allow exceptions for rape and incest.  Think about explaining that to your daughter!  These pillars of society have stated their neanderthal views on choice clearly in order to subjugate and/or disallow your choice: Todd Akin (R)Tom Smith (R), Roger Rivard (R), Steve King (R), and Richard Mourdock (R), or as Stephen Colbert recently dubbed them: “Team Rape which they probably wouldn’t appreciate, but c’mon they’re kinda asking for it.”

Amazingly, I do not recall these types of discussions or legislation regarding men’s bodies, and I would counsel these “men” to not “struggle” with their decision regarding choice because they do not need to make or live with that choice, the rape victim does.

Lastly and more importantly, I ask that all women take notice and fight for our rights by casting your vote for our freedom to choose what is best for ourselves now and in our future.

“I know you are smart and I know that you think

You’re doing what is best for me.

But if freedom is handled just your way

Then it’s not my freedom or free.”
